Publisher Axes New Corby ‘Fall Girl’ Book

SYDNEY

A controversial new book about Australian drug-smuggler Schapelle Corby has been scrapped by its publisher as her family anxiously awaits a decision on presidential clemency, The Bali Times can reveal.

The Chop: Publisher Allen & Unwin has withdrawn from the book, whose cover image is still available on its website.

The Fall Girl, by investigative journalist Eamonn Duff, had been due for release at the end of last year but was hit by an injunction preventing its publication.

Sydney-based publisher Allen & Unwin told The Bali Times this week it was not going ahead with the contentious project.

“This book was cancelled and will no longer be published by Allen & Unwin,” spokesperson Kylie Westaway said.

She declined to elaborate on the reasons behind the decision. A promotional page was still available on the publisher’s website this week, saying the book would be “Explosive and powerfully compelling” and “a fresh and revealing look at Schapelle Corby, her father’s drug-running business and how her run to Bali went so bad.”

It also says: “The Fall Girl provides a remarkable picture of a drug network that reached from Adelaide to Bali. It also reveals (Schapelle’s father’s) Mick Corby’s involvement in the cannabis trade and how Schapelle came to be paying the ultimate price for her father’s sins.”

The book is listed at booksellers as far away as Britain.

Duff, a journalist with Sydney newspaper the Sun-Herald, told The Bali Times this week he was “in limbo” over the book’s publication.

“I have no date yet. It’s in the hands of the publishers, I’m afraid,” he said.

Corby, 33, was arrested upon arrival in Bali in 2004 in possession of 4.2 kilograms of marijuana, which she was found guilty of importing onto the island and sentenced to 20 years’ prison. After the failure of successive appeals, she is seeking a presidential pardon on the basis of psychological problems.

She is one among a number of Australians serving prison terms for drugs offences at Bali’s Kerobokan Prison, while three of her fellow countrymen are on death row.

Corby’s saga has already been documented in a book, My Story, by Katherine Bonella, who has subsequently written a book, Hotel Kerobokan, about apparently dire conditions centring around drugs and sex inside the prison.

Last week visiting Australian Foreign Minister Kevin Rudd spoke with President Susilo Bambang Yudhoyono in Jakarta about Corby’s case and those of other Australians at Kerobokan Prison.

    Anyone who has lived on the Gold Coast in the last 20 or 30 years knows of this families dealings,come clean and stop pointing the finger at others Schapelle,especially when theyre dead and cant contradict you.Go play tennis or get your hair done, its not so bad in Kerobokan if you have money…..

    Dave I think you have it all wrong. I very much doubt that Schapelle or her family had anything to do with this book. My reading of this story is that the publisher and the author are using a dead person who can’t come back and contradict them not Schapelle. Your comment is also highly defamatory accusing the family of “dealings”. There has been no evidence at all that her family have been involved with drug dealing or smuggling if there was I am sure today tonight would of found something when Mercedes took them to court and won.

    Schapelle is innocent and most Australians are not stupid and know full well that know one takes MJ to Bali from Australia.
    If you what to know the truth of what the Authority’s did to cover up corruption in the Sydney airports by letting Schapelle take the fall, wait for a new move and book that is coming out soon.

    I know that Schapelle Corby, and every member of her family, are totally and unequivocally innocent of the crime for which she was so unjustly convicted.

    Allen & Unwin were unable to publish this book because it was full of completely provable lies, and they didn’t want to be sued. Further, according to the United Nations 2007 World Drug Report, marijuana sold for around US30 cents a gram on the streets of Bali in 2005, while it went for a whopping $US31 a gram in Australia at that time. So anyone who thinks an Australian citizen would smuggle dope FROM Australia, TO Bali (in those circumstances), needs a reality check. Further still, Alan Kessing, one of the most senior and respected figures in Australian customs (now retired), has just told ABC Australia (4th March 2011), that Schapelle was (without a shred of doubt), the victim of Australian airport corruption.

    Schapelle corby probably has got phycological problems as i would say most people in goal have. Do the crime do the time. No doubt in my mind she is guilty.

    I’ve always felt there was a significant possibility Schapelle was “doing time for Patsy Kline”. Lets face it if she had implicated another family member it wouldn’t have helped much. Although she says in the original Bonella book that she would never do time for someone else the reality is she really had no choice as the Indons simply would have said – prove to us it wasn’t a conspiracy knowing that would be impossible as they had refused to test and then destroyed all the important evidence with indecent haste.
    Even if she did know the hooch was in her bag she’s way more than done her time for the crime. For God’s sake, bring her home.

    Why would Allen & Unwin withdraw the book? Because they would prefer to avoid the consequences of defamation – injuring someone by making false damaging assertions? Why would a self-proclaimed “investigative journalist” write a book making claims that are in direct conflict to those of the Queensland Police Service, who have issued certificates certifying the absence of any disclosable court outcomes against Schapelle Corby, her parents, and her sister Mercedes.

    Easy to make false, libelous claims against a dead man. The sooner defamation laws are changed to allow next of kin to sue, the better. What do you thing would be the outcome? The same as the previous libels against members of the Corby family?

    How was the writing of this book funded? Why was it funded. Was it another part of the campaign of the Australian Government to manipulate public opinion through a campaign of lies? To cover up the corruption and involvement in drug running of the Australian Federal Police, the complicity of Qantas, the corruption which is a way of life in related agencies supposed to be acting in the public interest?

    I am ashamed to be an Australian. I am disgusted. I am furious. And I am distraught that an innocent Australian remains incarcerated, at the behest of the Australian Government, for a crime she did not commit.

    None of this makes Schapelle Corby guilty but the poor girl is poorly represented that’s for sure.
    Her sister says no one in the family has ever been done for drugs or had anything to do with drugs. Schapelle already admitted to smoking pot in her book? Her dad got fined $400 for a joint years ago in the 70’s but claims it wasn’t his. Her brother Clinton Rose, got a 15 month sentence in Queensland for breaking and entering and fraud. Later convicted of drug possession. Southport District Judge, Robert Hall, described as a “campaign of crime”. Clinton Rose pleaded guilty to a total of 62 charges accumulated over a six-month period. He was sentenced to three years’ probation. Later jailed 12 months for breaching conditions of his probation.

    Schapelle’s half-brother, James, who travelled with her to Bali, went to jail after he and two friends invaded the home of a well-known drug dealer, tied up the occupants and bashed a male occupant before fleeing with a quantity of cannabis and cash. Police said that the residents were threatened with an iron bar and menaced with a machete. Police found the cannabis in Schapelle’s mother’s home. The brother claimed he broke into the house of the dealer to find evidence to assist in his sister’s appeal. He went to court and pleaded guilty to eight charges: two counts of deprivation of liberty, two counts of assault occasioning bodily harm, and one count each of producing a dangerous drug, possessing a dangerous drug, possessing an item used in a criminal offence and entering a dwelling. He got a four year suspended sentence with a 10 month non-parole period.

    ROSS COULTHART: Is there anybody in your family, a stepfather, a distant relative … Is there anybody who’s ever been convicted or involved in the drugs trade?

    MERCEDES CORBY: No. Not that I know of. Nah. There wouldn’t be.

    Justice Carolyn Simpson said it was conceded on Mercedes Corby’s behalf that she had smoked marijuana but only on a few occasions years ago.

    They’re all squeaky clean alight. Their friends are all coming out on TV telling how they’re involved in drugs, cousins, neighbours, who next. Everyone you speak to on the the Gold Coast says the Corby’s have been into drugs for years? They say they have a real reputation. And didn’t her mum get done for shoplifting in Adelaide in her 20’s? That’s what one of their friends said. Or perhaps that was a lie too.

    She was caught red handed with kilos of marijuana in her luggage and the courts here have correctly convicted her and for Indonesia given here a light 20 year sentence.

    It is the weakest possible defence to say “someone must have put it there” as the offence is to be in possession, which she clearly was.

    Tough break if she is innocent but that is a risk you take in international travel.

    However she appears to have been quit properly caught, charged, tried and sentenced. Don’t blame the Indonesians, look to the lax morality of the Aussies who were smuggling drugs and blame them.

    Indonesia is a signatory to the Declaration of Human Rights.

    Article 11. * (1) Everyone charged with a penal offence has the right to be presumed innocent until proved guilty according to law in a public trial at which he has had all the guarantees necessary for his defence.

    Schapelle was not given all the guarantees necessary for her defence.

    She was denied fingerprinting of the plastic bags.

    She was denied a weight comparison of her baggage, to determine whether it was 4kg heavier than when checked in.

    She was denied forensic testing of the drugs to determine THC content (which would have established the quality of the drugs – bush weed or hydroponic) and country of origin.

    She was denied access to the CCTV footage from the camera above the Customs Counter, which could, and would, have corroborated her story about what happened, and what was said, when the boogie-board bag was placed on the counter.

    Her own sworn statement and the testimonies of all her witnesses were dismissed.

    Not one word of damning testimony by the prosecution’s witnesses was backed up by even a single piece of hard evidence.

    Not a single Judge in the panel of 3 had ever acquitted a defendant, and Chief Judge Linton Sirait had presided over 500 previous drug related trials.

    These are indisputable FACTS!

    As such, her trial was a sham, and the ‘guilty’ verdict resulting from it has no credibility.

    She was judged guilty, but she was not proven guilty, and her basic human right to a fair trial was ignored.

    Steve, some of what you say is right, much of it is wrong. However, NONE of it has any bearing on Schapelle.

    She may have smoked marijuana a couple of times in her teens, but she has not touched it in years. When arrested, she tested negative for ALL drugs. Since being in Kerobokan, where every kind of illicit drug is available, Schapelle has NEVER used them.

    The value of marijuana in Australia is far greater than it is in Indonesia. Schapelle had NO motive for taking the drugs there. Who would risk a death sentence, or a life sentence, just to lose money? No one.

    The actions of Schapelle’s family members have no bearing on Schapelle’s situation whatsoever. To suggest that they do is to imply “guilt by association” and this simply doesn’t cut it.

    I suggest you stop being influenced by the media smear campaign against Schapelle and her family, and start doing some real research of your own. There is more to this story than you could possibly imagine.

    Certificates have been issued by the Queensland Police for Schapelle’s father, mother, sister Mercedes and brother Michael, stating that there are NO ‘disclosable court outcomes’ (convictions) recorded against the names of these people in the records of police services in Australia. A similar certificate for Schapelle has been issued by the Australian Federal Police.

    So, Schapelle’s mum was not ‘done’ for shoplifting, because she would have had a conviction recorded against her name if she had been, and she does not.

    James conviction was recorded long after he travelled to Bali with Schapelle, and his crime does not involve the drug trade.

    Clinton has had a chequered past, but none of his crimes involve the drug trade.

    Both James and Clinton are living clean lives now.

    The following breaches of the Indonesian Code of Criminal Procedure (KUHAP)occurred:

    Article 66 – The suspect or defendant shall not be burdened with the duty of providing evidence.
    The following events resulted in the defendant being forced to seek evidence of any kind in a
    desperate bid to prove her innocence:
    · The outer plastic bag was handled by many people without protective gloves before the bag
    could be tested for fingerprints.
    · The total weight of the baggage was not compared with the total weight checked in at
    Brisbane airport.

    Articles 54 and 56 (1) – The right to legal aid lasts throughout the whole proceedings whenever the defendant is interrogated, from the beginning of the preliminary examination by the police interrogator to the trial, and at every stage.
    Schapelle Corby did not have legal counsel at the preliminary interrogation at Denpasar airport.

    Article 177 (1) – The right to the assistance of an interpreter free of charge if one cannot understand or speak the language used in court. The interpreter, to be appointed by the judge/chairman of the session, must promise under oath or pledge to truly interpret all that has to be interpreted.

    Article 53 – Extends the right outlined in Article 177 (1) to the preliminary examination.
    Schapelle Corby did not have an interpreter at the preliminary interrogation. She was interrogated by airline staff whose English-language proficiency has never been established and she does not understand Indonesian. For example, when Customs Officer Winata was interviewed by Liz Hayes on ’60 Minutes’ in November 2004, her questions to Winata were translated into Indonesian and Winata’s
    responses were in Indonesian and translated by an interpreter into English. Would this be necessary if Winata had good English speaking skills and good English listening skills?

    Article 51 – The suspect or defendant has the right to be clearly informed in a language he
    understands about what has been presumed about him at the start of an examination or the charges
    brought against him: a formulation which already implies the right to the assistance of an interpreter.
    (see Article 53, above)

    Articles 52 and 153 (2) – When the suspect is interrogated he must be in the condition to speak freely without pressure being brought to bear upon him by anyone and in any form. Best calculations suggest that Schapelle Corby was interrogated for nine hours – after 12 hours of
    travel.

    Articles 69 and 70 (1) – If the suspect has been arrested or detained, the legal adviser in turn has the right to be present and to speak with his client whenever he is being questioned, from the moment of arrest or detention and at all stages of the proceedings. Schapelle Corby’s access to a lawyer appears to have been hampered or denied for many hours. If “prima facie” evidence is all that the Indonesian justice needs to convict a suspect, why did the airport authorities interrogate Schapelle Corby for so long before allowing her to contact a lawyer?

    the drugs at the customs counter, nor of the initial interrogation which took place in the interview room
    later
    · The X-ray machine was not equipped to take photographs – so no image was available to
    show the location of the marijuana in the boogie board bag before it got to customs.

    Article 72 – The evidence collected by the investigators is accessible to the suspect and his counsel. On their request, the official concerned must provide them with a copy of the report of the preliminary examination.
    Access to the marijuana was refused throughout? The evidence was subsequently destroyed.

    Breaches of the International Covenant on Civil and Political Rights (ICCPR):

    Article 14 (3) (a): To be informed promptly and in detail in a language which he understands of the nature and cause of the charge against him.
