Denpasar District Court Executes Grand Balisani Hotel

Denpasar District Court executed a two units building Grand Balisani Hotel in Petitenget and Legian, Badung regency, after receiving a copy of the Supreme Court Decree Number 277 Pk/Pdt/2012 that won a lawsuit of one of the hotel owners.

“Then the two hotels will be auctioned,” said the Denpasar District Court Bailiffs Komang Bayu Wirawan in Petitenget, Kuta, Badung regency.

The two disputed hotels, each stands on an area of 12,800 square meters in Batu Belig, Petitenget, and 3,850 square meters in Legian.

Wirawan explained that in the preliminary act independent reviewer team were taken from the Office of Public Assessment Services Muttaqin Bambang Purwanto and colleagues who will do the measurement and assessthe hotel building.

“The purpose of the interpretation is to determine the sale value of the building that will be auctioned,” he said.

While the defendant is the owner of the two hotels, namely Soehardjo Gondo and Hendy Setiawan.

Meanwhile, Martin Suryana as the attorney of Lie Ping Thien, stated that the case occurred in 2006, which began from a dispute among the hotels owners, namely Lie, Soehardjo, and Hendy.

“The hotel was purchased in 2001 by three people with composition of Lie 45 percent, Gondo 45 percent, and Hendy 10 percent,” he said.

The three men then formed a company to manage the hotel. But the hotel is not an asset of the company, but privately owned by three of them.

Problems arise because among the owners finally happened disharmony that broke up their partnership.

There are several options proposed by the owners of the hotel to make all parties have equal profit. But they do not agree in deciding the option.

“Then in 2009 Lie Thien Ping filed a civil lawsuit to end ownership among the three men. The lawsuit was eventually won by our clients,” he said.

The court authorized the plaintiff to auction off the hotel and the result is distributed according to each portion.
